This Newsletter and Marketing Communications Consent (this "Consent") explains how you may agree to receive newsletters and other marketing communications from Fleamily Inc., a Delaware corporation (File Number 10632227), doing business as Fledge, with a mailing address at 228 Park Ave S, PMB 85451, New York, NY 10003, United States ("Fledge", "we", "us" or "our"), how we will use your contact details for this purpose, and how you can withdraw your consent at any time.

This Consent supplements, and is incorporated into, the Fledge Terms of Use (the "Terms"), in particular Section 10.5 (Electronic Communications), and our Privacy Policy. Capitalized terms used but not defined in this Consent have the meanings given to them in the Terms.

1. What you are consenting to

1.1. By giving this Consent (as described in Section 3 below), you agree that Fledge may send you newsletters and other marketing or promotional communications by email to the email address associated with your Account or otherwise provided by you, including, without limitation:

  • newsletters and digests about the Services, including new features, product updates and improvements;
  • offers, discounts, promotions, campaigns, contests and events relating to the Services;
  • dating, safety and usage tips, editorial content and community highlights;
  • invitations to participate in surveys, research, beta programs or feedback initiatives; and
  • where permitted by applicable law and disclosed to you, communications about offers of our affiliates or partners relating to the Services.

1.2. This Consent covers marketing communications only. It does not apply to transactional, service, security or legal communications described in Section 10.5.2(a) of the Terms (for example, verification codes, security alerts, billing and subscription notices, or changes to the Terms or policies), which we may send you regardless of this Consent as necessary for the operation of the Services and your Account.

1.3. This Consent covers email communications. Push notifications and in-app messages are controlled separately through your device and in-App settings, as described in Section 10.5.5 of the Terms. Any consent to receive marketing text (SMS/MMS) messages, if and when offered, will be requested separately as described in Section 7 below and is not granted by this Consent.

2. Consent is voluntary

2.1. Giving this Consent is entirely voluntary. You do not have to agree to receive newsletters or marketing communications in order to create an Account, use the Services, or purchase any subscription or feature. Refusing or withdrawing this Consent will not affect your access to or use of the Services.

3. How you give this consent

3.1. You give this Consent by taking a clear affirmative action, such as:

  • ticking an unticked (pre-unchecked) checkbox referring to this Consent during sign-up or within the Services;
  • enabling the relevant marketing or newsletter toggle in your Account or notification settings;
  • submitting your email address through a newsletter sign-up form that refers to this Consent; or
  • confirming your subscription via a confirmation link in an email we send you (where we use a double opt-in process).

3.2. We will keep a record of your consent, including the date and time it was given, the channel and interface through which it was given, and the version of this Consent in effect at that time, in accordance with our Privacy Policy and applicable law.

4. How to unsubscribe

4.1. You may withdraw this Consent and unsubscribe from newsletters and marketing communications at any time, free of charge, by any of the following means:

  • clicking the "unsubscribe" or opt-out link included in every marketing email we send;
  • changing your marketing or notification preferences in your Account settings within the App; or
  • contacting us at support@fledge.love with a request to unsubscribe.

4.2. We will honor your opt-out request promptly and in any event within ten (10) business days, as required by the CAN-SPAM Act and its implementing rules. You will not be required to pay any fee, provide any information other than your email address and opt-out preference, or take any step other than sending a reply email or visiting a single web page in order to opt out.

4.3. Withdrawal of this Consent does not affect:

  • the lawfulness of communications sent before the withdrawal takes effect; or
  • our right and obligation to send you transactional, service, security and legal communications as described in Section 1.2 above and Section 10.5.4 of the Terms.

5. How we process your data for newsletters

5.1. In connection with newsletters and marketing communications, we process the following categories of personal data: your email address; your name or profile name (if used for personalization); your language, region and communication preferences; and engagement data relating to our emails (such as delivery, open, click and unsubscribe events), which we use to measure performance and improve our communications.

5.2. We may use reputable third-party email delivery and marketing service providers acting on our behalf and under contractual confidentiality and data protection obligations to send and analyze these communications. We do not sell your email address to third parties for their own marketing purposes.

5.3. Our processing of personal data in connection with this Consent is further described in our Privacy Policy, including your privacy rights under applicable U.S. state privacy laws (such as rights of access, deletion and correction, and "Your Privacy Choices" mechanisms, where available).

5.4. We will retain records of your subscription status and consent for as long as you are subscribed and thereafter for the period necessary to demonstrate compliance with applicable law, including maintaining your email address on our suppression list to ensure that your opt-out is respected.

6. Eligibility

6.1. Newsletters and marketing communications are intended only for individuals who are at least eighteen (18) years old and eligible to use the Services under Section 3.1 of the Terms. If we become aware that we have collected an email address of a person under 18 for marketing purposes, we will delete it from our marketing lists.

7. Text (SMS/MMS) messages

7.1. If we offer marketing text messages, we will request your prior express written consent separately, in accordance with the Telephone Consumer Protection Act (TCPA) and applicable carrier and industry requirements. Such consent will:

  • identify Fledge as the sender;
  • describe the nature and approximate frequency of the messages;
  • state that message and data rates may apply;
  • state that consent is not a condition of any purchase or of the use of the Services; and
  • explain how to opt out (for example, by replying STOP) and how to get help (for example, by replying HELP).

7.2. Your agreement to this Consent does not constitute consent to receive marketing text messages or calls.

8. Changes to this consent

8.1. We may update this Consent from time to time, for example to reflect changes in law, our Services or our communication practices. If we make material changes that expand the scope of the communications you receive or the data we process under this Consent, we will notify you and, where required by applicable law, ask you to renew your consent. The current version will always be available within the Services, with the "Last updated" date indicated above.
