Event Host Agreement
Date of publication: October 14, 2026
This Event Host Agreement (the “Host Agreement”) applies when you create an in-person event (an “Event”) in the Events section of Fledge. It is an Additional Term under Section 2.4 of the Fledge Terms of Use (the “Terms”) and forms part of your agreement with Fleamily Inc. (d/b/a Fledge) (“Fledge”, “we”, “us”). Capitalized terms that are not defined here have the meaning given in the Terms.
PLEASE READ THIS HOST AGREEMENT CAREFULLY. YOU ARE THE ORGANIZER OF YOUR EVENT AND YOU ARE RESPONSIBLE FOR IT. SECTIONS 7 AND 8 CONTAIN AN INDEMNITY IN FAVOR OF FLEDGE AND A RELEASE OF CLAIMS AGAINST FLEDGE, INCLUDING CLAIMS BASED ON THE NEGLIGENCE OF FLEDGE.
1. Your role
1.1. You are the sole organizer of your Event and the person responsible for it.
1.2. You are not an agent, contractor, employee, partner or joint venturer of Fledge, and you have no authority to act or make statements on behalf of Fledge.
1.3. You must not describe your Event as a “Fledge event” or as hosted, organized, sponsored, endorsed or insured by Fledge, and you must not use the Fledge name, logo or other trademarks in connection with your Event, except to state that the Event is listed on Fledge.
1.4. Fledge provides only the technology through which you publish your Event and Users sign up for it. Fledge does not attend, staff, supervise, secure or insure your Event.
2. Who can host
You may create an Event only if you are at least 18 years old, you have completed photo verification and your Account is in good standing.
3. Your listing
3.1. The information in your listing must be accurate and complete: what the Event is, where and when it takes place, who it is for and any cost of taking part.
3.2. Before your Event is published, Fledge reviews its description for compliance with the Community Guidelines. This review is not an approval of you, the venue or the Event and does not reduce your responsibility. If you change a published listing, the changes may be reviewed again.
3.3. The full address of your Event is shown to every User who signs up. Do not use a private residence as the venue.
3.4. Your listing is User Content under the Terms.
4. Your undertakings
You confirm and undertake that:
- the venue is a public place that is open to your guests, and is not a private home, a hotel room or another private residence;
- you have the consent of the venue and every permit, license and approval required for the Event;
- the number of guests will not exceed the lawful capacity of the venue;
- the Event is for adults only and you will not admit anyone under 18;
- you will not sell alcohol or charge for it; alcohol at your Event may be sold or served only by a venue licensed to do so, and no alcohol will be provided to anyone under 21;
- no illegal drugs or weapons will be permitted at the Event;
- you will be present for the whole Event, respond to incidents, call 911 in an emergency and cooperate with emergency services and law enforcement;
- you will report to Fledge at support@fledge.love, without delay, any incident at your Event involving injury, violence, sexual misconduct, harassment or the police;
- you will not unlawfully discriminate against any guest;
- you will not use the Event to sell or advertise goods or services, to recruit for a business or scheme or to raise money;
- you will comply with the Terms, the Community Guidelines and all applicable laws, including laws on safety, noise, consumer protection and tax.
5. Guests’ information
5.1. You may use the guest list and the profile information of your guests only to run the Event.
5.2. You must not copy, export or disclose that information or use it to contact guests for any other purpose, and you must not photograph or record guests without their consent.
5.3. If your Event uses sign-up codes, you may scan them only to confirm that a guest has signed up.
6. Paid entry and insurance
6.1. Fledge does not collect or process payments for Events. If taking part in your Event costs money, your listing must state the full price, including all fees, and who the seller is. You (or the seller you name) are solely responsible for sales, refunds, cancellations, chargebacks and taxes.
6.2. Fledge does not insure you, your Event, the venue or your guests. You decide whether to obtain insurance, and you bear the consequences of not having it.
6.3. If your Event has paid entry, is expected to have more than 50 guests, or involves physical, sporting or water activities, you must hold commercial general liability insurance covering the Event with limits of at least US$1,000,000 per occurrence and US$2,000,000 in the aggregate, and provide a certificate of insurance to Fledge on request.
7. Indemnity
7.1. To the fullest extent permitted by applicable law, you will indemnify, defend and hold harmless Fledge, its parent and affiliated entities and their respective officers, directors, employees, agents and licensors (the “Fledge Parties”) from and against all claims, demands, actions, liabilities, damages, losses, fines, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your Event, including any claim for bodily injury, death or property damage and any claim brought by a guest, the venue, a public authority or another third party; (b) your listing; or (c) your breach of this Host Agreement, the Terms or applicable law.
7.2. This indemnity does not apply to the extent that a claim is caused by the gross negligence or willful misconduct of a Fledge Party. Sections 14.4 to 14.6 of the Terms apply to this indemnity.
8. Your own risk; release
8.1. You host your Event at your own risk.
8.2. To the fullest extent permitted by applicable law, you release the Fledge Parties from all claims, demands, liabilities, damages, losses, costs and expenses of any kind arising out of or relating to your Event, including the acts or omissions of guests, the venue or any other third party. THIS RELEASE INCLUDES CLAIMS BASED ON THE NEGLIGENCE OF THE FLEDGE PARTIES. It does not apply to the gross negligence, recklessness or intentional misconduct of a Fledge Party or to any liability that cannot be released, excluded or limited under applicable law.
8.3. Sections 12 (Disclaimers) and 13 (Limitation of Liability) of the Terms apply to Events.
9. Fledge’s rights
9.1. Fledge may decline to publish, remove or cancel the listing of your Event, restrict you from creating Events and take any other Enforcement Action under Section 11 of the Terms, at any time and without stating reasons, to the extent permitted by law.
9.2. Fledge may notify the guests of your Event of its removal or cancellation. Fledge is not responsible for any costs or losses you incur as a result.
9.3. If you change or cancel your Event, you must do so through the Services without delay. If your Account is deleted, your Events that have not yet taken place are cancelled.
10. Disclosure of information
You agree that Fledge may show your profile and your listing to Users and that, where an incident connected with your Event is reported, Fledge may disclose information about you and your Event to emergency services and law enforcement authorities, as described in the Privacy Policy.
11. Time limit for claims; disputes
11.1. To the extent permitted by applicable law, any claim by you against the Fledge Parties arising out of or relating to your Event must be commenced within one (1) year after the date of the Event; otherwise it is permanently barred.
11.2. Sections 15 (Dispute Resolution, Arbitration and Class Action Waiver) and 16 (Governing Law and Venue) of the Terms apply to any dispute arising out of or relating to this Host Agreement or your Event.
12. Acceptance and changes
12.1. You accept this Host Agreement by ticking the acceptance box when you create an Event. We keep a record of your acceptance.
12.2. We may update this Host Agreement. If we do, we will ask you to accept the new version before you create your next Event.
13. Local law
Nothing in this Host Agreement excludes or limits any right that you have under mandatory consumer protection law and that cannot be waived by contract. If any part of Section 7, 8 or 11 is unenforceable in your jurisdiction, it applies to the maximum extent permitted there, and the remaining provisions stay in force.
